How to submit a notice
If you believe content on xeniadata.com or in our data product infringes a copyright you own or are authorized to act for, you may submit a written notice to our Designated Agent. To be effective, your notice must include all of the following:
- A physical or electronic signature of the owner (or person authorized to act on behalf of the owner) of the copyright
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material claimed to be infringing, with information sufficient for us to locate it (URL, hotel slug, or other specific identifier)
- Your contact information (name, address, phone, email)
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner
Our response
Upon receipt of a valid notice, we will: (a) remove or disable access to the allegedly infringing material expeditiously; (b) take reasonable steps to notify the user or partner who provided the material; and (c) terminate the account of repeat infringers in appropriate circumstances.
Counter-notice
If you believe material was removed in error, you may submit a counter-notice to our Designated Agent containing: identification of the removed material and its prior location; a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification; your contact information; and a statement that you consent to the jurisdiction of the federal court in the district where you are located (or for non-U.S. residents, the Northern District of California).
Hotel data corrections — separate process
If you operate a hotel listed in our data product and you want to claim, correct, supplement, or request removal of your listing, please contact [email protected]. The hotel-correction process is faster than DMCA and does not require a copyright claim.
False or fraudulent notices
17 U.S.C. § 512(f) provides for damages, including costs and attorneys' fees, against anyone who knowingly materially misrepresents that material is infringing or was removed by mistake. Submit notices in good faith.
